The legal evidence and fact of ownership — not a physical document

People speak of "getting the title" as if it were a certificate, but title is the state of owning. The deed is the instrument that transfers it. Nothing called "the title" is handed over at a closing on real estate.

How the exam asks about it

The deed–title distinction is examinable in its own right and underlies the recording questions: a deed can exist without valid title behind it.
