Marketable title
Title a reasonable buyer would accept, free from serious doubt or litigation risk
A practical standard rather than a perfect one. Ordinary recorded utility easements do not make title unmarketable; an undisclosed lien, a break in the chain or an encroachment that exposes the buyer to a lawsuit does.
How the exam asks about it
Most purchase contracts oblige the seller to deliver marketable title, which turns this definition into a contractual obligation rather than a vocabulary item.
