A lawsuit asking a court to settle competing claims and confirm ownership

The remedy when a cloud cannot be cleared by agreement — an unknown heir, an old claimant who cannot be found, a boundary in genuine dispute. The court’s judgment binds the parties and is recorded, which is what makes title marketable again.

Frequently paired with adverse possession: a successful adverse possessor generally must bring a quiet title action to obtain a title anyone will insure.
