Partition
A court action dividing co-owned property or ordering it sold
The remedy when co-owners cannot agree. A court divides the land physically where that is practical, and where it is not — a single house, for example — orders a sale and divides the proceeds.
How the exam asks about it
Available to tenants in common and joint tenants. It is generally not available to a tenancy by the entirety, since neither spouse may act on the property alone.
