Contracts
Executory contract
A contract in which something remains to be done
A signed purchase contract awaiting closing, a lease part-way through its term, an option not yet exercised. The contract is fully binding; it is simply not finished.
How the exam asks about it
The period between contract and closing is the exam’s favorite illustration, and it is also when the buyer holds equitable title.
